Article 1(2) of Council Directive (EEC) 93/13 should be interpreted as meaning that a contractual term, such as that at issue in the main proceedings, which referred to the national law applicable so far as concerned the determination of jurisdiction to hear disputes between the parties to the contract, did not fall outside the scope of that directive. The Court of Justice of the European Union so held in a preliminary ruling in proceedings concerning the territorial jurisdiction of national courts to hear an action for payment of the sale price, brought by the seller or supplier against the consumer.
