The Court of Justice of the European Union ruled that art 5(2)(b) of European Parliament and Council Directive (EC) 2001/29 had to be interpreted as precluding a scheme for fair compensation for private copying which, like the one at issue in the main proceedings, was financed from the general state budget in such a way that it was not possible to ensure that the cost of that compensation was borne by the use of private copies.
