The Court of Appeal dismissed the appeal by the appellant Nottingham City Council against a decision of the Upper Tribunal (Lands Chamber) in which the tribunal had upheld the imposition of a condition, in a licence of a house in multiple occupation, requiring an attic bedroom to be occupied by a full-time student. Subject to the amendment of the licence in the way accepted by the respondents, the Court rejected the authority's contention that the condition was unlawful.
