Arbitration – Award. A contention that the tribunal had ignored or failed to have regard to evidence relied upon by one of the parties could not be the subject matter of an allegation of a serious irregularity within s 68 (2)(a) or (d) of the Arbitration Act 1996. So ruled the Commercial Court in dismissing an application by the defendants to an arbitration, who had challenged an award of over US$300m made in favour of the claimants in the arbitration. The court held that the defendants had failed to establish that there had been serious irregularities by the tribunal, under s 68 of the Act, or that it had failed to act fairly, under s 33 of the Act.
