European Union – Freedom of movement. The Court of Justice of the European Union gave a preliminary ruling deciding, among other things, that art 64(1) of the Treaty on the Functioning of the European Union should be interpreted as applying to national legislation which imposed a restriction on the movements of capital referred to in that provision, such as the extended recovery period at issue in the main proceedings, even where that restriction could also be applied to situations which had nothing to do with direct investment, establishment, the provision of financial services or the admission of securities to capital markets.
