Immigration – Illegal entrant. The Court of Justice of the European Union ruled, among other things, that the European Parliament and Council Directive (EC) 2008/115 precluded legislation permitting a third-country national in respect of whom the return procedure established by that directive had not yet been completed to be imprisoned merely on account of illegal entry across an internal border, resulting in an illegal stay and where the national concerned might be taken back by another member state under art 6(3) of the Directive.
