Contract – Construction. The application of the first to third defendants for an order that the English court had no jurisdiction to try the claimant company's claim failed, in a dispute concerning the supply of Airbus aircraft by the claimant. The Commercial Court held that the words 'any dispute arising out of or in connection with the warranties agreement' in the contract between the parties extended to a dispute as to substantive rights under the warranties. Further, the defendant insurers were bound by a jurisdiction agreement in the contract, and hence the English courts had jurisdiction.
