European Union – Trade marks. The applicant company's application for annulment of the decision of the Fourth Board of Appeal of the European Union Intellectual Property Office relating to opposition proceedings between the applicant and the intervener company, Hotel Cipriani Srl (HC), was dismissed. The General Court of the European Union held that the Board had correctly upheld the decision to reject the applicant's application for registration of the word sign 'CIPRIANI' as an EU trade mark. According to the Court, HC had proved genuine use of the earlier EU word mark 'HOTEL CIPRIANI' and there had been a likelihood of confusion on the part of the relevant public concerning all of the contested goods.
