The obligation for compulsory insurance of vehicles contained in Directive (EC) 2009/103 extended to the driving of a motor vehicle on private land, and was directly effective against the state through its emanation, the second defendant Motor Insurers' Bureau. Accordingly, the Queen's Bench Division held that Motor Insurers' Bureau was contingently liable for the accident suffered by the claimant, when he was struck by the first defendant's car while walking on private land.
