A sign which referred to the characteristic of a product or service which was that it could be found in abundance in a single place with a high degree of value and quality, could not constitute an indication of geographical origin. The Court of Justice of the European Union so held, in a preliminary ruling, in the course of proceedings between the applicant proprietors of the Spanish trade mark 'La Milla de Oro' and Abadia RetuertaSA, concerning the use by that company of the sign 'El Pago de la Milla de Oro' for commercial, promotional or advertising purposes with regard to wines.
