The defendant Secretary of State's refusal to direct the claimant's release from prison on compassionate grounds relating to the health of his mother, under s 30 of the Crime (Sentences) Act 1997, had not been procedurally unfair and there had been no detectable legal error as to the threshold of the assessment of risk. The Administrative Court further held that, on that basis, the Royal Prerogative of Mercy application had been bound to fail.
