The judge had not erred in rejecting the claimants' challenge to the defendant Secretary of State's package of changes in a document entitled 'Community Planning in 2016/2017 and beyond – Final Package'. In particular, the Court of Appeal, Civil Division, rejected grounds based on Secretary of State for Education and Science v Metropolitan Borough of Tameside ([1976] 3 All ER 665), misuse of the relevant statutory provisions for the payment of pharmacies to achieve a fundamental restructuring of the community pharmacy system and breach of the obligation under s 1C of the National Health Service Act 2006.
