Article 19(1) of Directive (EC) 2006/54 should be interpreted as applying to a situation, such as that at issue in the main proceedings, in which a breastfeeding worker challenged, before a court or other competent authority of the member state concerned, the risk assessment of her work in so far as she claimed that the assessment had not been not conducted in accordance with art 4(1) of Council Directive (EEC) 92/85. The Court of Justice of the European Union so held in a preliminary ruling in proceedings concerning the refusal to issue a certificate stating that the performance by the applicant employee of the tasks relating to her work posed a risk to breastfeeding her child for the purposes of the grant of a financial allowance in respect of risk during breastfeeding.
