The Court of Justice of the European Union ruled that whether the broadcast of television programmes on televisions installed by a rehabilitation centre constituted a 'communication to the public' had to be determined within both art 3(1) of European Parliament and Council Directive (EC) 2001/29 and art 8(2) of European Parliament and Council Directive (EC) 2006/115, and in accordance with the same interpretive criteria. Further, those two provisions had to be interpreted as meaning that such a broadcast constituted an act of 'communication to the public'.
