Negligence – Duty to take care. The claimant had failed to establish any breach of duty or causation against the defendant train operating company for his fall between a platform edge and a train in the course of departing from a station. The Queen's Bench Division, in dismissing his claim, held that there was no justification for the claimant's criticism of the driver, his criticisms of the defendant's procedures were misplaced and there was nothing in the behaviour of any of the passengers on the platform which should have caused a relief platform supervisor any concern.
