The General Court of the European Union dismissed the action by T & L Sugars and another company for damages for the loss which those companies had allegedly suffered as a result of: (i) certain measures adopted by the European Commission designed to increase the supply of sugar on the European Union market; and (ii) the Commission's refusal to take the necessary measures to re-establish availability of supply in raw cane sugar. The General Court held that the conditions necessary for the non-contractual liability of the EU had not been satisfied.
