Charity – Benefit to community. The Court of Appeal Civil Division dismissed the appeal of W, who had been evicted from a property of which possession had been granted by trustees of a charity. In so doing the court found that W was not periodic tenant of her home and assuming that arts 8 and 14 of the European Convention on Human Rights were engaged, the denial of security of tenure to almspersons was clearly justifiable as a proportionate measure which secured a fair balance between the interests of charities and current and future almspersons.
