European Union – Jurisdiction. The defendant applied unsuccessfully for a declaration that the courts of England and Wales had no jurisdiction to try the claims brought against him by the claimant companies and an order that the claim form be set aside. The Commercial Court held that the English court, as the court of the member state in which the defendant had been domiciled at the date that the action had been commenced, had jurisdiction under s 5 of Regulation (EU) 1215/2012 in relation to all of the claims made in the present action.
