European Union – Freedom of movement. Arts 63 and 65 of the Treaty on the Functioning of the European Union had to be interpreted to the effect that they precluded legislation of a member state, such as that at issue in the main proceedings, which provided that the failure to comply with an obligation to declare significant sums of cash entering or leaving the territory of that state was punishable with a fine which could be up to double the undeclared amount. The Court of Justice of the European Union so held in proceedings concerning the fine imposed on the applicant for failure to comply with the obligation to declare certain cash sums on leaving Spanish territory.
