Damages – Personal injury. The claimant brought a claim for damages for clinical negligence in respect of a significant brachial plexus injury to the his right upper limb as a result of the circumstances of his birth in 2002 at a hospital for which the defendant NHS Trust was responsible. Liability causation and quantum were all in issue. The Queen's Bench Division held that the defendant was liable and that the negligence had caused the injury. Damages were awarded accordingly.
